When we think of taxes, we most likely look at what we pay to the Federal government and the states where we live, but there are dozens more, incorporated into everything we purchase. Every time we might the government to tax the corporations, we are asking them to tax us. Corporations view taxes as an expense like paying the electric bill. Democrat Complains: Balanced Budget Amendment Would Make it “Virtully Impossible to Raise Taxes”

House Minority Whip Steny Hoyer (D.-Md.) said on the House floor last night that if the balanced budget amendment Republicans are supporting is ratified and included in the Constitution it would make it “virtually impossible” to raise taxes.
“In order to pay our bills, Republicans would require us to pass a Constitutional amendment that would permanently enshrine their partisan budget priorities in law and make it virtually impossible to raise revenue,” Hoyer said.

The push for a balanced budget amendment is part of the Republican Cut, Cap and Balance plan. This plan would increase the federal debt limit by $2.4 trillion in exchange for cutting federal spending by $111 billion next year and for congressional passage of a balanced budget amendment that, if ratified, would require supermajority votes in Congress to increase taxes, increase the debt limit, or spend more than 18 percent of GDP in a given fiscal year.

Hoyer was evidently alluding to the amendment’s requirement that taxes could only be increased with a supermajority vote of Congress when he said the proposal would make it “virtually impossible to raise revenue.”

Paying taxes is a fact of life, because there are certain things that our federal government must provide as enumerated in the Constitution. But paying taxes does not have to be unfair, burdensome and costly. Our current system of taxation is all three, and it got that way little by little over time since 1913.

The Fair Tax (H.R. 25) is a fairer tax because it is just the opposite. It is fair because the consumer determines their taxes based on their purchase behavior instead of being determined by the government based on one’s capacity to produce. Our production is measured in terms of personal income and business profits.

The Fair Tax is a one-time one-point national sales tax on new goods and services. It is not collected on wholesale purchases, but rather, it is collected on retail purchases when the consumer consumes, and not when the consumer or business produces. This is totally consistent with Economic Guiding Principle #1 as described in Cain’s Economic Vision Part 1.

The Fair Tax is also fair because everybody pays the same consumption rate of 23 percent. Liberals hate that concept because it does not give them a tool to redistribute the income of others as with the current tax code. The rate is revenue-neutral and replaces all federal income and payroll taxes.

That’s right! There will be no more income tax fillings and no more Internal Revenue Service! That would be another day of independence worth celebrating.

As the big government liberals start screaming about how the Fair Tax is unfair to the poor, it actually empowers those with modest incomes through a sales tax pre-bate for basic necessities when coupled with a zero tax on used goods and services. My dad would have achieved his American dreams a lot sooner if we had had the Fair Tax in his lifetime.

It is a burden on every worker and business to have to keep track of nearly every financial transaction made during the year in order to try and comply with the ridiculous tax regulations. Even worse, it costs us collectively about $430 billion dollars a year. That’s insane!

In contrast, each state would collect the federal retail sales tax, as about 45 of them do today for their state sales tax, by adding one additional line to the sales receipt and sending those proceeds to the newly created Sales Tax Administration (STA). The STA would be for administrative purposes only, with no authority or mechanism to harass the taxpayers. The states would enforce the collection of sales taxes from retailers as they are already doing.

It’s called not reinventing the wheel.

The opponents of replacing the tax code with the Fair Tax will launch their usual distortions and lies against the Fair Tax. The most common ones include that it’s on top of the federal taxes we already pay. That’s a lie. Or, that the rate is really 30 percent, which is another lie.

Proposed legislation clearly states that the rate is 23 cents on a dollar of goods purchased. Over time, the taxes embedded in that dollar will go away due to price competition, such that the item costing one dollar will now cost 77 cents. The consumer still pays only 23 cents, which would make the 23 percent tax look like a 30 percent tax, if you divide 77 cents by 23 cents. The liberals call it inclusive versus exclusive rate to confuse people, but they don’t bother to tell you it’s the same 23 cents.

Replacing the current tax code with the Fair Tax is Phase Two of my Economic Vision for America, discussed in Parts 1 and 2 in the two previous commentaries. We must take some time to introduce and explain the concept of shifting taxation from income to consumption, and how it is fairer, flatter, simpler and less burdensome and costly than what we are doing today.

As president, I will end the insanity of the current tax code.

It’s common sense.

BP’s New Deal is a Raw Deal
Yesterday, BP announced that it would “voluntarily” place $20 billion into a government-administered fund to compensate victims of the Gulf of Mexico oil disaster and clean up the mess. The oil company also agreed to shell out another $100 million to a foundation that will support oil workers made unemployed by President Barack Obama’s indefinite ban on offshore oil drilling.

Now, no one is disputing that this oil spill is real disaster wreaking enormous havoc on the environment and the economy. And BP should absolutely have to pick up the tab for all efforts to correct this mess. It’s the beauty of the “you break it, you buy it” mentality. But there are right ways – legal and constitutional ways – to go about assigning responsibility, and the Obama Administration isn’t following them.

Heritage Foundation legal scholar Hans von Spakovsky explains the law pertaining to the Gulf Coast situation:

The Oil Pollution Act of 1990 (OPA) sets out exactly what BP and anyone else who caused the spill have to pay for. Under 33 U.S.C. § 2702, BP is responsible for all removal costs; all injuries to real or personal property; damages for loss of subsistence use of natural resources; loss of profits or impairment of earning capacity due to injury, destruction, or loss of natural resources or real or personal property; and damages for the cost of providing increased public services by any state. These categories of damages would cover all of the costs that everyone has been talking about…

But the law says nothing about BP compensating the newly unemployed offshore oil workers. Why and how, then, can BP be liable? Legally, they can’t. “Obama’s moratorium is an unreasonable decision that is supported neither by the states in the Gulf nor experts in the oil and gas industry,” von Spakovsky argues. In addition, the President’s demand to transfer an immense portion of stockholders’ wealth to the compensation fund without any legislation or court decision is extremely worrisome.

So why would BP “voluntarily agree” to these costly measures? Perhaps the company was intimidated by Attorney General Eric Holder’s threat to open a criminal investigation. Perhaps BP is under the impression this agreement places a cap on their costs. (It doesn’t. The White House made clear that the $20 billion was just a down payment and in no way represented a cap on BP’s liability.)

Or perhaps this so-called deal between the White House and BP represents little more than what Heritage’s Conn Carroll calls of “shakedown of Godfather-like proportions.” BP is by no means off the hook with this deal – it has to pay big-time; it is still liable to individual and state claims; and it received no assurances that economic damages would not be higher or that the White House wouldn’t come back demanding more.

But Carroll explains in a separate piece that BP is not the victim in this scenario. The rule of law is.

Wednesday’s ‘voluntary’ deal between BP and the Obama administration was nothing less than a continuation of President Barack Obama’s ongoing assault on the rule of law. Capitalism only succeeds if it is a profit and LOSS system. Well-managed firms should have every right to keep their profits, but mismanaged firms must be allowed to suffer losses… Failure is a necessary component of capitalism. But this administration refuses to allow the rule of law to work. From Fannie Mae to Freddie Mac, from GM to Chrysler, from AIG to Citibank, our government continues to subvert the established rule of law. This lawlessness creates uncertainty in the business environment, and it is a huge reason why our economy is not recovering as it should be.

Obama,” We are headed in right direction”. He doesn’t want to go back to what hasn’t worked…
